Understanding Divorce Law in Nevada.

Nevada operates as a no-fault divorce state, meaning couples can dissolve their marriage without proving wrongdoing by either party. According to Nevada Revised Statutes Chapter 125, the most common grounds for divorce include incompatibility and living separately for at least one year.

Types of Divorce Cases

Contested Divorce

When spouses cannot agree on key issues such as property division, spousal support, or child custody arrangements, contested divorce proceedings become necessary. Our divorce lawyers work diligently to negotiate fair settlements while preparing for litigation when needed.

Uncontested Divorce

For couples who agree on major divorce terms, uncontested divorce offers a more streamlined and cost-effective approach. We guide clients through proper documentation and court procedures to ensure all legal requirements are met.

High-Asset Divorce

Complex property division involving substantial assets, business valuations, and retirement accounts requires sophisticated legal strategies. Our attorneys have extensive experience protecting clients' financial interests in high-net-worth divorce cases.

Divorce Property Division in Nevada

As a community property state, Nevada requires equitable distribution of marital assets and debts acquired during marriage. Understanding what constitutes separate versus community property under Nevada divorce law is essential for protecting your financial interests.

Marital vs. Separate Property

Community Property includes:

  • Income earned by either spouse during marriage

  • Real estate purchased during marriage

  • Retirement benefits accrued during marriage

  • Business interests developed during marriage

Separate Property typically includes:

  • Assets owned before marriage

  • Inheritances received by one spouse

  • Personal injury settlements

  • Gifts given specifically to one spouse

Spousal Support (Alimony) in Nevada

Nevada courts may award spousal support to provide financial assistance to the lower-earning spouse following divorce. Alimony decisions consider factors such as marriage length, earning capacity, health, and standard of living during marriage.

Types of Spousal Support

  • Temporary Support: Provided during divorce proceedings

  • Rehabilitative Support: Short-term assistance while recipient gains education or job skills

  • Permanent Support: Long-term support for marriages of significant duration

Child Custody and Visitation Rights in Nevada.

Child custody determinations in Nevada prioritize the best interests of the child above all other considerations, as mandated by NRS 125C.0035. Understanding your custody rights and options is crucial for protecting your relationship with your children during and after divorce proceedings.

Types of Child Custody Arrangements

Legal Custody
Legal custody grants parents the authority to make important decisions regarding their child's education, healthcare, religious upbringing, and general welfare. Nevada courts may award joint legal custody or sole legal custody depending on circumstances as outlined in the Nevada Self-Help Center's custody overview.

Physical Custody
Physical custody determines where children primarily reside and spend their time. Arrangements can include joint physical custody, primary physical custody with one parent, or shared custody schedules that maximize both parents' involvement.

Visitation and Parenting Time
When one parent receives primary physical custody, the non-custodial parent typically receives structured visitation rights. We help create detailed parenting plans that establish clear schedules and expectations for both parents.

Factors Nevada Courts Consider in Custody Decisions

Under NRS 125C.0035 Nevada courts evaluate multiple factors when determining child custody arrangements, including:

  • Each parent's ability to provide a stable, nurturing environment

  • The child's relationship with each parent and siblings

  • Parents' mental and physical health

  • History of domestic violence or substance abuse

  • The child's preference (for children of sufficient age and maturity)

  • Geographic proximity and practical considerations

  • Which parent is more likely to allow frequent contact with the other parent

Child Support Calculations and Modifications

As of 2020, Nevada transitioned from simple percentage-based calculations to more complex tiered formulas. Our attorneys ensure accurate calculations and help clients understand their rights regarding support modifications when circumstances change.

Nevada Child Support Formula

The current formula for determining a parent's base child support obligation is based on gross monthly income (GMI) tiers:

First $6,000 of GMI:

  • 1 child: 16%

  • 2 children: 22%

  • 3 children: 26%

  • 4 children: 28%

  • For each additional child, add 2%

Income from $6,001 to $10,000:

  • 1 child: 8%

  • 2 children: 11%

  • 3 children: 13%

  • 4 children: 14%

  • For each additional child, add 1%

Income above $10,000:

  • 1 child: 4%

  • 2 children: 6%

  • 3 children: 6%

  • 4 children: 7%

  • For each additional child, add 0.5%

This tiered approach replaced the previous formula and eliminated the statutory caps on payments.

When Child Support Can Be Modified

According to NRS 125B.145, child support modifications may occur:

  • Every three years through automatic review

  • Significant changes in either parent's income (20% or more change)

  • Changes in child custody arrangements

  • Medical needs or educational expenses

  • Changes in the child's needs as they age

Protecting Your Rights During Divorce and Custody Proceedings.

Document Everything

Maintain detailed records of all interactions with your spouse, especially regarding children. This documentation can be crucial evidence in custody proceedings.

Follow Court Orders

Strictly comply with all temporary orders regarding support, custody, and property. Violations can negatively impact your case.

Prioritize Your Children's Well-Being

Courts favor parents who demonstrate their commitment to their children's best interests. Avoid involving children in adult conflicts.
